Lease non-renewal and termination

Non-renewal and lease termination notices, and what makes one effective.

Awaiting attorney review

This playbook is written and sourced, but a qualified Virginia reviewer has not signed off on it yet. Use it to understand the landscape and to prepare, not as a legal conclusion, a deadline, or a remedy.

A termination or non-renewal notice has formal requirements. Form, reason, delivery and the date received all matter, and the sequence around it can matter too.

What the law says

  • A notice that your lease will not be renewed, or that it is being terminated, is a legal document with formal requirements. It is not the same thing as a court order.
  • Whether the notice is effective depends on its form, the reason given, how it was delivered, and the date it was received; not just the date printed on it.
  • If you complained about conditions or organized with neighbors shortly before the notice, that sequence is worth preserving and worth raising with a lawyer.

Steps tenants usually take

  1. 01Keep the notice and envelope, and write the received date on it.
  2. 02Ask for the reason in writing if none was given.
  3. 03Check the notice against your lease and against the statutory requirements.
  4. 04Call legal aid before the period in the notice runs out.
  5. 05If a complaint or organizing preceded the notice, save that timeline; it may matter.

Do not skip these

  • The period in a termination notice may be shorter than you expect. Call legal aid the day you receive it.
